This Privacy Policy explains how Otternative Marketing GmbH ('Otternative', 'we' or 'us') collects, uses and protects your personal data when you visit otternativemarketing.com, get in touch, subscribe to our newsletter, book a call or buy a product. We process personal data in line with the Swiss Federal Act on Data Protection (revFADP/nFADP) and, where it applies, the EU General Data Protection Regulation (GDPR).

What personal data we collect

Data you give us directly. When you fill in our contact form, subscribe to the newsletter, book a discovery call or buy a product, we collect the information you provide — typically your name, email address, company name, the content of your message and, for bookings, your chosen date and time. If you buy a product, payment is handled by our payment provider; we never see or store your full card details.

Data we collect automatically. When you browse the site, we and our service providers collect technical and usage data through cookies and similar technologies — such as your IP address (often shortened or anonymised), device and browser type, the pages you visit, the page that referred you, your approximate location, and interactions like clicks and form submissions.

How and why we use your data

We use your personal data to:

  • respond to your enquiry and provide the information or services you ask for;
  • send you our newsletter, where you have subscribed;
  • operate, secure, analyse and improve the website;
  • process purchases and meet our accounting and record-keeping obligations;
  • comply with our legal obligations.

We rely on the following legal bases, as applicable: your consent (e.g. the newsletter and non-essential cookies), the performance of a contract or steps taken at your request, our legitimate interest in running and improving our business, and compliance with legal obligations. We do not sell your personal data, and we do not use it for automated decisions that produce legal effects.

Cookies and analytics

We use a limited set of cookies and privacy-respecting analytics to run the site and understand how it is used. These include PostHog (website and product analytics, hosted in the EU), Sortlist Radar (attribution tracking of sessions, form submissions, clicks and downloads), and functional cookies set by embedded tools such as our Cal.com booking widget.

You can accept or decline non-essential cookies and manage them through your browser settings. Declining them may limit some features of the site.

Service providers we work with

We share personal data only with carefully selected service providers ('processors') that help us run our website and business, under agreements that require them to protect your data and use it only on our instructions. These include:

  • Vercel — website hosting and content delivery;
  • PostHog — website analytics (EU-hosted);
  • Brevo — newsletter and email/CRM;
  • Cal.com — discovery-call booking;
  • Sortlist — attribution and partner tracking;
  • Stripe — payment processing for purchases;
  • Google and Meta — where you interact with our ads or embedded content.

We may also disclose personal data where required by law, or to establish, exercise or defend legal claims.

International data transfers

Some of our providers may process data outside Switzerland or the EU/EEA. Where that happens, we rely on appropriate safeguards — such as adequacy decisions, the EU Standard Contractual Clauses and the Swiss addendum — so that your data stays protected to an equivalent standard.

How long we keep your data

We keep personal data only for as long as we need it: enquiry and project data for the duration of our relationship and a reasonable period afterwards; newsletter data until you unsubscribe; accounting records for the statutory retention period (ten years under Swiss law); and analytics data for a limited period, after which we delete or anonymise it.

Your rights

Depending on where you are, you have the right to:

  • access the personal data we hold about you;
  • have inaccurate or incomplete data corrected;
  • have your data deleted;
  • restrict or object to certain processing;
  • receive your data in a portable, machine-readable format;
  • withdraw your consent at any time, where processing is based on consent (this does not affect processing carried out beforehand).

To exercise any of these rights, email us at marketing@otternativemarketing.com. You also have the right to lodge a complaint with a supervisory authority — in Switzerland, the Federal Data Protection and Information Commissioner (FDPIC); in the EU/EEA, your local data protection authority.

How we protect your data

We use appropriate technical and organisational measures — including encryption in transit (HTTPS), access controls and vetted providers — to protect your data against loss, misuse and unauthorised access. No transmission over the internet is ever completely secure, but we work hard to safeguard your information.

Children

Our website and services are intended for businesses and adults. We do not knowingly collect personal data from children.

We may update this Privacy Policy from time to time. The current version is always available on this page, with the 'last updated' date shown beneath the title. We encourage you to review it periodically.
